What is a Writ of Habeas Corpus?
While everyone has heard of the "Writ of Habeas Corpus", very few people, including many lawyers, have a clear sense of what it is and what it's used for. The Habeas Corpus Writ dates back to 14th Century England and is a legal action that prevents the government from keeping someone in custody wrongfully.

How is the Writ of Habeas Corpus Used?
The Writ of Habeas Corpus is used when there is some question about whether the government has the authority to hold a person in custody. When there is a issue about whether the incarcerated person actually committed a crime, or whether the State followed proper procedures in the process of taking and holding the person, the Habeas Corpus Petition forces the Court to look at the circumstances of the arrest and incarceration to decide whether the individual should go free.
